So, I had a plan, a good plan, and a court hearing at 10 am Thursday to get someone out of my house. I have a lawyer, the daughter has a lawyer, proof of full guardianship is needed.


So, I left the house at 3:30 am to go to a client's. I am not a people person and have to be home by 2 for the classes I teach, Zoom office hours. So, I get a text just before noon from the caregiver, "should I lock your doors?" Ok, I bit. Found out the person, made her call ER at 8:30 am and was transported to hospital by 9:30. So, there is no way in hell, she is ill. When she is ill, she refuses to go but today, she begged for an ambulance.


I am pissed for 2 reasons:


1. I am done with the fake drama from a selfish nutcase who thinks she is no inconvenience. I will stop there.


2. The caregiver has no right being in my house, billing Medicaid for hours by herself. It is beyond ridiculous.


So, of course, they cannot find anything wrong with her but they have admitted her because of liability for the night. Funny thing is the SW had a paper drawn up to delay the hearing, even though it's her day off. My lawyer and the sis lawyer were notified and the hearing is delayed.


So sis lawyer called me and dropped more f bombs than I do over "mommy dearest," the manipulative SW and this complete s***show.


So, anyway, I am at the house, she is gone and the caregiver is here for the night shift. I told her to leave but I am not on the careplan and she needs to play on her phone....sorry, I mean do laundry.


Does anyone have an idea on what to do?

I'm afraid any suggestions I might have come of reading way too many mystery novels. And are more than likely terribly inappropriate.

Lilhelp, this hearing was to get her out based on the last hearing. She did not comply. The grand plan was the out of country sis to apply for guardianship but her lawyer act as guardian/conservator. My lawyer is working with hers just to get her out. Already cancelled cable, changed wifi passwords, forwarded all calls after 8 pm to SW, turned off a stove breaker and replaced it with a indiction burner after caregiver decided to heat the place with an oven and I got an 1100 electric bill, walked naked and had my grandma do the same around the house due to cameras Medicaid said justified 24/7 care, called police on caregivers over stolen cc charges, etc. I could write a book. Problem is I am "difficult" when I actually caregave in her house, a worker stole, admitted it, we had a meeting and I was mean because I did not think a thief should be in the house. Also, the fake acussations, etc. I am so beyond done. So the agency cannot listen to me.

Oh. I'm so sorry. You're not "difficult." They're covering up for their abuse, messes, thieving, inept workers by making you feel like that; that's abusive to you. They're hurting more than helping. Hope you get good help very soon. lil

I am so glad you have legal advice.

Surely eviction notice can be served without the actual tennant being there? (But I really wouldn't know). I know my sister did not need to attend the court hearing regarding finances. Medical report was reviewed & a trustee appointed.

I think I'd be tempted to do a 'midnight flit' like in the old days... pack my essentials & sneak out in the quiet of the night... into my newly rented one bedder. Then removalists booked for other belongs to be transfered into storage. Then rent the property out for 6 months.

Course that all depends on making the eviction stick & then to physically remove those people.

I hope some solutions present themselves. Strength to you.

What about calling your attorney and asking what you can do legally to put a stop to some of what's going on. Maybe an emergency hearing in front of a judge?

Can you call Medicaid and report the caregiver in your home with no one to care for? Maybe tell them you have no idea why they're at your home anyway since their patient's at the hospital.

Can you make your home and wherever the caregiver roosts so uncomfortable the caregiver will want to leave? and for the other person, too? Lights out at ..oh, I don't know..maybe 6pm!? No WiFi access or anything electronic. Food, beverages are unavailable. Start moving furniture out or filling furniture with things so furniture can't be used for the purposes intended ..so the caregiver has to sit in the floor? Take pillows off beds and hide them along with blankets ... It could get ugly... Or you can dream of doing those things and more ~ and call your attorney and ask what can you do to expedite something being done asap before you lose your sanity.

Your house, you can ask her to leave and tell the aide that. I see where this has nothing to do with the Careplan. She is not getting paid because the client is not present. I have never understood if its your house how others can take it upon themselves to dictate who is allowed in your house.

Ask lawyer when they release her from Hospital, can you refuse to allow her back? If so, this would be the opportunity.

I wish you would give us a refresher on how this started. Put it in your profile. I seem to remember some of the earlier problems but not totally.

I feel bad about all you have had to go through.

But, how are suggestions to be made, when the story is about 95 percent missing? It’s like saying, “Something on my arm hurts. Can you tell me how to fix it?”

Cept, you won’t tell us about the broken bones, or the one that is sticking up through the open, bleeding skin.

So you are trying to serve an eviction notice via a hearing to someone who has set up a medical reason not to attend the hearing? To delay. Is that it? Wow.

I know nada on law...

It was actually an eviction hearing. At the first hearing, there were rules: 24/7 Medicaid care, pay rent, Medicaid hire her a fiscal intermediary and a 3rd party POA, not family with mommy issues she could manipulate. None of the things were done...nada. They put up live stream cameras. So she was gone. Sis' friend who's entire legal practice is conserverativeships was going to do it.

So yesterday, she pulled a stunt. She knows well, chest pain = nitro pills. The fire department is here several times a week, she always refuses to go in. All of a sudden yesterday, she begged the worker to call 911 and her "family that loves her" instead of people who wont fall for the drama.

So now, they cannot find anything wrong with her but she is on a 3 day observation at the hospital. So she misses the hearing and will never be accountable for anything.

Oh, Medicaid pays for her lawyer so they stopped services because she is in the hospital, so hearing cannot happen without representation. But the normal worker, showed up and is upstairs now "working," lol since Medicaid did not cancel that.

I guess you are down to reschedule when she is out. The thing is, she will pull this again in all likelihood. At least you are started on all this, Stacey, and I suppose it is just going to take forever.
